Processing of personal data – information according to the General Data Protection Regulation (2016/679/EU), GDPR
Introduction
The Law firm Engström & Co AB is Controller of the personal data we receive and process when preparing a commission or in connection with a confirmed or ongoing commission.
Personal data includes all information that can be related to a natural person and expresses his / her identity eg in physical, economic or social terms (see Article 4, paragraph 1, GDPR).
You are not required to provide personal data to us, but if you refuse to do so, we cannot undertake a commission since we will not be able to carry out the necessary checks for conflict of interests and money laundry. If you refuse to provide personal data in an ongoing commission we may possibly no longer be able to take care of your interests with due care and best practice, which can lead to legal loss and / or to the Law firm abandoning the commission.
Processing of personal data
We process the data in order to perform mandatory conflict of interests checks and (if applicable) money laundering checks, carry out and administer the commission, to safeguard your interests as well as for accounting and billing purposes. These data are processed on the basis of article 6, 1 paragraph, b) and c) GDPR.
The data can also be used for business and method development, market research, statistics and risk management. The data processed for the purpose of developing and analysing the business is processed on the basis of our legitimate interest in accordance with article 6, 1 paragraph, f) GDPR to develop the busi-ness and communicate with our clients and other contacts. We never disclose information to third parties for marketing purposes.
We will not disclose personal data to third parties such as courts, authorities, counterparties and counterparty representatives and other third parties, except in cases when/if
(i) it is specifically agreed upon between the Law firm and you,
(ii) it is necessary with respect to the nature of the commission in order to exercise your rights,
(iii) it is necessary for us to comply with statutory duty or to comply with authority or court decisions; or
(iv) we engage third parties such as external service providers to undertake certain tasks on our behalf.
Duration of Storage
The personal data are stored, in accordance with the obligation that the Law firm Engström & Co AB has in compliance with the Code of Conduct, for a period of ten years from the date of completion of the case, or a longer period if required for the specific case.
Right to information etc.
You have the right to free of charge request information from the Law firm Engström & Co AB regarding the use of the personal data relating to you. You also have the right to receive your personal data in a machine-readable format or, if technically possible, to transmit the data to a third party on your instruction.
You also have the right to request that your data is not processed for direct marketing purposes.
We will correct or delete information that is incorrect or limit the processing of such information at your request or on your own initiative.
Supervisory Authority
If you are dissatisfied with our treatment, you can file a complaint to a supervisory authority which in Sweden is the Data Inspection (www.datainspektionen.se). You can also contact the supervisory authority of the country where you live or work.
